Terms & Conditions WinADreamKerryHome Fundraiser

  1. The promoter of this competition draw is Barraduff Community Field Organisation Ltd (hereinafter referred to as “BCFO”).
  2. The Main Purpose of the draw is a fundraiser to raise necessary funds to develop a new multi-purpose Sports and Recreational Hall for everyone in our community. The Fundraiser needs to be a financial success. BCFO will not derive any personal profit from this and it is not connected with gaming, wagering, money laundering or lotteries.
  3. BCFO is a non-profit organization with registered Charity Number CHY 19627.
  4. The Draw is a private member draw open to anyone worldwide subject to the purchaser and member being restricted to natural persons over 18 years of age. If it transpires that the ticket purchaser is under 18 years, whether by individual member or syndicate, then the ticket will be null and void and the entry fee is forfeited.
  5. Entrants must answer a qualifying question “In what County is the house located?”. Answer is required.
  6. Upon the purchase of a ticket, the purchaser becomes a social member of BCFO until the draw is completed.
  7. The cost of each entry to the draw will be €100.00 (Euro) and there is no limit on number of tickets a member can purchase.
  8. There will be a maximum number of 15,000 tickets.
  9. The prizes are non-transferrable and are vested solely in the winner/s.
  10. The first number drawn from the drum will be the winning number of the first prize (house). The second number drawn will be the winning number of the second prize (car) and so on. Winning numbers will not be returned to the drum once they are drawn.
  11. First Prize is a 3-bedroom detached house valued at €270,000 (as of October 2020) located in Barraduff, Killarney, County Kerry.
  12. Second Prize is car valued at €17,000 (Mitsubishi 2021 SPACESTAR).
  13. First and Second Prize are as stated, and no cash or other alternatives will be offered.
  14. Only those who have purchased this membership ticket and answered the qualifying question correctly are eligible to participate in this draw.
  15. These terms and conditions are governed by Irish Law.
  16. BCFO reserves the right to disqualify any contestant for any reason whatsoever in its sole discretion.
  17. BCFO does not accept any responsibility whatsoever for any technical failure or malfunction or any other problem in any network, system, server, provider, or otherwise which may result in entries being lost or not properly registered or recorded and contestants hereby waive any claim whatsoever for any losses, costs, damages and expenses arising from any such problems.
  18. Entry into this competition draw will be deemed to be a full and unconditional acceptance by the applicant of the Terms and Conditions of this competition.
  19. Participation in BCFO competitions denotes acceptance of these terms and conditions and any additional competition specific terms and conditions which may be advertised.
  20. BCFO reserves the right to add additional prizes where necessary.
  21. Once purchased, Membership is non-refundable except in circumstances where the Competition must be cancelled by the organisation. In that event, a maximum amount of €90.00 per Membership purchased will be refunded to Members.
  22. We allow syndicates for the draw. It is the responsibility of the syndicate to arrange their own agreement and to appoint and register one person only for the ticket. This person will act as the single point of contact for the draw. In the event of a syndicate winning, we require notification within 30 days of the name to be put on the deed or else the property will be transferred by deed to all members of the syndicate jointly as tenants in common.
  23. Any public notice or announcement about this draw is a notice to members of BCFO or to other persons concerned.
  24. BCFO committee’s decision in respect of all matters to do with the competition will be final and no correspondence will be entered into in respect of the competition or the competition result.
  25. The legal title to the Property will be transferred to the winner free from any financial interest, entitlement, or encumbrances in favour BCFO as soon as practicable following the Competition Draw.
  26. The winner will be required to appoint his or her own Solicitor to act in the transfer of the Property.
  27. If the winner does not appoint a Solicitor and take steps within 28 days of claiming the prize to effect the transfer of the legal title to the Property to them and in any event enter in to a Deed of Transfer to so transfer the property within six months from the date of claiming the prize, BCFO reserves the right to withdraw the prize from the winner and select a replacement winner.
  28. The winner will be responsible for all or any legal costs in the transfer of the Property to include the legal fees of their Solicitor, Stamp Duty, Registration Expenses and any & all other related outlays or expenses.
  29. The winner(s) of the house draw shall accept the fit-out and finish of a 3-bedroom detached two-storey dwelling house as provided by the builder without recourse to BCFO Committee on completion of the house.
  30. The winner agrees to the use of his or her name and image in any publicity material as well as their entry. Any personal data relating to the winner or any other entrants shall be used solely in accordance with current Irish Data Protection Legislation GDPR in connection with the draw and will not be disclosed to a third party without the entrants prior consent.

  32. The Promoter reserves the right to seek and issue publicity on behalf of the entrants. By entering the promotion, the entrants agree to participate in publicity as and when reasonably requested surrounding the promotion.
  33. The implementation, conduction and certification of this draw will be fully supervised by an Independent Adjudicator Legal Team.
  34. The Competition Draw will take place in Barraduff Community Centre in June 2021 and will be broadcast over Facebook.
  35. BCFO reserves the right to cancel, terminate, modify or suspend the competition and/or vary the competition rules, and/or the Terms and Conditions at any time, without prior notice.
  36. The winning ticket and ticket holder will be subject to verification by BCFO and their agents. This process may take up to 7 days or more to complete. The winner will be notified by phone and email or by direct message on Twitter/Facebook or by registered postal letter within 28 days of the draw date. The winner will be deemed to have been notified on the date of the email notification or direct message on Twitter/Facebook or within 3 days of the date of delivery of any postal letter. If the winner cannot be contacted or does not claim the prize within 14 days of notification, BCFO reserves the right to withdraw the prize from the winner and pick a replacement winner. In this event, any subsequent draw will take place in accordance with these terms and conditions until a new winner is established. This is applicable to all prizes.
  37. BCFO shall not be liable for any failure in the performance of any of its obligations caused by factors outside of its control.
  38. BCFO Executive and all Sub-Committees are not eligible to participate in this novel WinADreamKerryHome Draw.
  39. BCFO will strictly adhere to all HSE COVID-19 guidelines while competition is ongoing.
